I am no fan of Orin Hatch (Teddy's BFFL) but he and the two Kens make some great points in this op-ed.

Why the Health-Care Bills Are Unconstitutional

The last paragraph says it all. If Obama, Reid, and Pelosi manage to bribe enough Democrats to throw away their political careers, the legislation will face an uphill battle in federal court.

[INDENT]America's founders intended the federal government to have limited powers and that the states have an independent sovereign place in our system of government. The Obama/Reid/Pelosi legislation to take control of the American health-care system is the most sweeping and intrusive federal program ever devised. If the federal government can do this, then it can do anything, and the limits on government power that our liberty requires will be more myth than reality.[/INDENT]

It is unimaginable that the democrat senators would have the audacity to believe that they could actually get away with something as unconstitutional as trying to stop future lawmakers from amending certain parts of this bill or law - that is like saying you can't amend the Constitution! I never thought I would say this but - BRING ON THE LAWYERS!!!

Sen. Ben Nelson (D-Neb.) reached out Thursday evening to South Carolina GOP Attorney General Henry McMaster, the leader of a group of 13 Republican state attorneys general who are threatening to file suit against the Senate health care bill, and urged him to forgo any legal action, POLITICO has learned.

According to a copy of a memo sent by McMaster’s chief of staff to other GOP state attorneys general detailing the call, Nelson asked McMaster to “call off the dogs,” a reference to recent threats by the state AGs to file a lawsuit challenging the constitutionality of a Medicaid provision in the bill that benefits Nebraska at the expense of other states.
