Passing legislation does not require a 2/3rds majority vote, except to override a presidential veto. Cloture, whichs allows the Senate to avoid a filibuster of a bill, requires a 3/5ths majority. In the U.S., we elect 2 senators per state and we have 50 (not 57) states, which means that it takes 41 votes to cut off debate on a bill and block a vote.

Of course when we have presidents like Barack Obama, who have no respect for the Constitution, only the Supreme Court provides any effective check on their power. If Obama gets to name anoter liberal or two to the court, then our federal government will be closer to a dictatorship than a democracy where the will of the majority matters.
