Where is the death penalty defined as murder? The US Constitution requires that defendants get due process. Provided that those accused of capital crimes receive their due process, there is no Constitutional issue with the application of the death penalty.

As for abortion, the US Supreme Court has ruled, wrongly in my opinion, that there is a constitutional right of abortion based on an implied right of privacy. However, the Supreme Court has also ruled that the states may regulate abortions.

The difference in abortion and capital punishment that liberals have difficulty in grasping is the difference between innocence and guilt. There is no moral equivalency between taking the life of an unborn child and taking the life of a convicted murderer. Yet, the left thinks (oxymoron?) that conservatives who oppose abortion but support capital punishment are guilty of hypocrisy.

Believing that abortion is murder and capital punishment is justice is not intellectually inconsistent at all if a person understands the concept of innocence.

I agree as long as you do not bring religion into it. I do believe if you are a devout Christian and base life around Christian beliefs(which I do not base mine), you should be against both as the 10 commandments state thou shalt not kill. This supercedes all the statements of an eye for an eye which is a common argument in their defense. The bible states "he who is without sin cast the first stone". Who is? I do believe that capital punishment and war are warranted and justified on many occasions but I do believe that they are sins in gods eyes. That being said. I do not like the liberals getting into my wallet and I do not like the conservatives telling me how to live my personal life when they are doing just the opposite. I believe it is my right to drink beer, hunt, shoot guns, go to strip clubs without the left or the right telling me what to do. If I want to mine coal on my land, it is my business. If I want to open a strip club on my land, it is my business. I do not want the constitution manipulated in either direction for one groups personal gain.
