Ben-Gal Sarah Jones subject of investigations

Cincinnati Ben-Gals cheerleader and Northern Kentucky teacher Sarah Jones, who gained national attention by suing a gossip website that claimed she was promiscuous, is now the subject of two investigations.

Kentucky Attorney General Jack Conway has been asked to assign a special prosecutor to a criminal case. The board that certifies teachers in Kentucky is also investigating Jones and she resigned Nov. 30 from Dixie Heights High School in Edgewood.

What law enforcement officials and educators will not say is what the 26-year-old Jones has been accused of doing.

Lawyer Eric Deters, whose Independence firm represented Jones in the defamation suit, also wouldn’t say what the investigation was about but said, "Sarah Jones maintains that she’s innocent, that this is just a terrible rumor and it’s my understanding that the alleged victim denies it also,” Deters said. “Sarah is being fully cooperative, and there have been no charges filed against her.”

Conway’s spokeswoman, Allison Gardner Martin, said the attorney general’s office had received a letter requesting a special prosecutor be appointed to the criminal case, but later refused to say who had been assigned to the case. A subsequent open records request for the letter was denied. Assistant Deputy Attorney General Mitchel T. Denham cited a law that exempts records from public inspection if the release could harm an ongoing criminal investigation.

Kenton Commonwealth’s Attorney Rob Sanders confirmed he had referred the case to Conway’s office but declined to comment on the conflict that prevented him from prosecuting the case.

The investigation by the Education Professional Standards Board in Frankfort could cost Jones her teaching certificate if she is found culpable. The board issues and renews certification for all Kentucky administrators and teachers. If there is a complaint against a teacher, it goes through the board, which has the power to revoke or suspend certification.

“We do have a pending disciplinary case where (Sarah Jones) has been named the certificate holder,” said Alicia Sneed, director of legal services for the board. She expects it will be several months, possibly May, before a decision is made on that case.

The board does not provide any details of pending cases, so the case against Jones may or may not have anything to do with her resignation. Jones cited “personal reasons” in a one-sentence resignation letter dated Nov. 29 and obtained through an open records request. It was accepted by Kenton County School District Superintendent Terri Cox-Cruey the following day.

Jones’ personnel file is immaculate – nothing but great reviews. She started at the high school in August 2006 and was teaching freshman English when she resigned.

In court filings from 2010, Jones claimed the posts about her on the gossip website had affected her. The school district had to block the website because so many students were viewing the site on school computers, Jones said, adding her work email was flooded with crude emails from people who had seen the posts.

The high school principal at the time even reviewed security camera footage after one post on the website alleged Jones was having sex in her classroom, the Enquirer reported in August 2010.

Jones has since gone on several television shows, from “20/20” to “Anderson Cooper,” to speak about the embarrassment and public scrutiny she faced after the online posts.

U.S. District Judge William Bertelsman awarded her an $11 million judgment for libel and defamation in August 2010 but lawyers for the website claim their client doesn’t have to pay it. The defendants have filed a motion essentially asking that the suit be dismissed. Bertelsman heard oral arguments on the motion Dec. 9 but has not yet ruled.

The website’s lawyers claim, among other things, that the site is immune from liability for content other people create and submit to the site. It encourages viewers to submit embarrassing photos of people and then allows people to comment on them. Deters argued that the site’s operator edits and creates some of the comments – including some pertaining to Jones.

As of Thursday evening, web surfers were still commenting about Jones on the gossip website.

Um, he's sick. My best friend's sister's boyfriend's brother's girlfriend heard from this guy who knows this kid who's going with the girl who saw Ferris pass out at 31 Flavors last night. I guess it's pretty serious.

Guy's, ditto for me! I never had a teacher like this! Heck, the teachers that I had daydreams about had kids as old as Sarah Jones.....
