Mother of drowned child sues pool owner

Just saw this on story on kentucky.com.

First of all, I'd like to say that this is a terrible accident, and it is a tragedy any time a young life is cut short. My prayers are with the family.

Now, my opinion on the legal aspect? This lawsuit should be thrown out. The company may or may not have been negligent with regards to the drain, but to me the girl (and her family) forfeited their right to sue for negligence by her being in the pool illegally. If the girl had been swimming with permission and this happened, then my opinion would have been different.

The company was supposed to have a fence around the pool to keep out trespassers, which they did. The lawyer who filed the suit even admits this much, saying he "didn't know how" the girl got inside.

To me, this gets at a larger issue with today's court system. IMO, if someone goes onto a private property without permission and gets hurt, then too bad for them. No way should they be allowed to sue for something that happened while they were illegally trespassing.

I agree totally. The way I see it is the girl was breaking and entering, along with trespassing. I hate it that she died but is not the pool's owners fault.

I agree completely. We in this country do not respect the rights of property owners nearly enough.

What I dont understand is how our judges, who are suppose to interpet our laws and uphold our freedoms, let suits like this go on.

Goes right along with the people that get bit by dogs because they are taunting them through the fence. The person that tries to break into your house and you shoot him. The list goes on and on. The lady who burnt herself on the coffee at McDonalds.
I realize that none of these are as tragic but they are all examples of how our justice system is flawed.

People need to learn to take responsibility for their and their childrens actions. The loss is tragic but the condo complex should not be held responsible.

It's time for people to take responsibility for their actions.

this is garbage.

I think whoever makes the decision to jump in the pool. Should take the charges and consequences theirselves.

I agree completely. The problem is, no one has to take any responsibility because of our justice system today. Do something you're not supposed to and get hurt because of it? No problem, just shift the blame onto someone else and sue them. Rolleyes
